This Assumption of Risk disclosure is provided by All Access Cheer Universe LLC ("HQCheer") to inform all users of the inherent risks associated with cheerleading activities. By using HQCheer, you acknowledge and accept the risks described herein.
Cheerleading is a physically demanding athletic activity that involves tumbling, stunting, jumping, and other acrobatic movements. These activities carry inherent risks of injury, including but not limited to sprains, strains, fractures, dislocations, concussions, spinal injuries, and in rare cases, catastrophic injury or death. These risks exist regardless of the precautions taken by coaches, athletes, and facility operators.
By using HQCheer and participating in any cheerleading-related activities, training, or instruction accessed through the platform, you acknowledge that you understand the inherent risks of cheerleading, you voluntarily choose to participate despite these risks, injuries can occur even with proper technique, equipment, and supervision, and online coaching and video reviews cannot fully replace in-person instruction and spotting.
HQCheer provides online coaching resources including video reviews, live webinars, and expert guidance. Users must understand that online coaching has limitations compared to in-person instruction. Coaches cannot physically spot or intervene during skill attempts. Video reviews are based on the footage provided and may not capture all relevant factors. Recommendations are general in nature and may not account for individual physical limitations, injuries, or conditions. Users should always have qualified in-person supervision when attempting skills, especially new or advanced skills.
HQCheer strongly recommends following our Skill Progression Chart and never attempting skills beyond your verified ability level. Athletes should master foundational skills before progressing, always use proper equipment and training surfaces, ensure qualified spotters are present per our Spotting Guidelines, follow the Injury Prevention Guide, and stop immediately if pain or discomfort occurs.
HQCheer is not a medical provider and does not offer medical advice. Users should consult with a physician before beginning any cheerleading training program, disclose all relevant medical conditions to their coaches, not participate while injured without medical clearance, seek immediate medical attention for any injuries sustained, and not rely on HQCheer coaching feedback as a substitute for medical advice.
For athletes under 18, a parent or legal guardian must review and acknowledge this Assumption of Risk on their behalf. Parents and guardians are responsible for ensuring their minor athlete trains in a safe environment with qualified in-person supervision. HQCheer's online coaching services supplement but do not replace proper in-person coaching for minor athletes. See our Children's Privacy (COPPA) policy for additional protections for minors.
To the maximum extent permitted by Texas law, by using HQCheer you release and hold harmless All Access Cheer Universe LLC, its officers, directors, employees, coaches, and affiliates from any and all claims, damages, losses, or expenses arising from your participation in cheerleading activities, use of information or guidance obtained through the platform, injuries sustained during training or practice, and equipment malfunction or environmental conditions. This release does not apply to claims arising from gross negligence or willful misconduct by HQCheer.
This Assumption of Risk is governed by the laws of the State of Texas. Texas Civil Practice and Remedies Code provisions regarding assumption of risk and inherent dangers of sport apply to cheerleading activities conducted in connection with HQCheer services.
HQCheer requires annual re-acknowledgment of this Assumption of Risk for all active users. You will receive a reminder email 30 days before your annual renewal date with links to the current version of this document and our Terms of Service.
